The Mabrey Firm is compassionately committed to the representation of families who suffer from the devastating loss of loved ones due to the negligence of another. This is called Wrongful Death. Wrongful Death can occur as a result of medical malpractice, nursing home negligence and abuse, trucking and auto accidents, and other causes.
The loss of a loved one that is sudden and unexpected makes the grieving process associated with death even more difficult. The Mabrey Firm will find out why a loved one died. The Mabrey firm will determine whether a loved one’s death was avoidable. We have the resources to investigate the circumstances of the death, preserve all necessary evidence, and identify the responsible parties.
In Georgia, only certain individuals are entitled to recover from the loss of a loved one. Generally, when the deceased is an adult, the surviving spouse is first in line to bring the action. The spouse is required to share a portion of any recovery for a wrongful death claim with the children of the deceased. However, the surviving spouse is guaranteed a one-third percentage of any such recovery. If there is no surviving spouse, then the child or children of the deceased have standing to bring the action, and they would share equally in any award. All children are treated equally. The fact that a child is born out of wedlock will not be a bar to recovery.
The Mabrey Firm will assist your family in appointing the appropriate representative of your loved one’s estate for purposes of pursuing the action. We will work aggressively throughout the course of litigation to obtain the most favorable outcome. The Mabrey Firm will also assist you in the distribution of any proceeds from a wrongful death claim.
